Competition Terms and Conditions
Artist refers to anyone who registers under the bands section of the Global Moguls website.
Top 6 refers to the artists that get to the Top 6 stage of the competition.
For the terms of this agreement, the artist agrees to undertake the tasks of the Global Moguls online competition.
Costs incurred in undertaking the tasks of the competition must be covered by the artist, and in no way will Global Moguls be liable for any costs incurred in performing these tasks.
Global Moguls is in no way liable for any cost, damage, personal injury or death suffered while performing these competition tasks.
Global Moguls is not liable for any loss or damage incurred by the artist, patrimonial or otherwise, whilst the competition is active.
The artist agrees that their music and material will be displayed and used throughout the Global Moguls website (competition platform), which will be viewed by the participating public at large.
Ownership of the said materials will always vest with the artists whom produced the songs, photographs, designs and videos.
Bands and artists undertake and agree that to enter the competition, and for the duration of the competition they are unsigned to any music label or management contract, and will remain so for the duration of the competition.
Artists undertake to ensure that their songs and music is original and that ownership of the said songs and music entered into the competition belongs to the bands and artists. Global Moguls is not liable for any infringement of this clause by the artist.
The artist agrees to not infringe the rights of any other artists, and Global Moguls is in no way responsible for the infringements of the rights of any third party, and will in no way be responsible or involved in any third party claim against any individual or group entering into the competition.
Global Moguls is not liable for any copying of songs, photographs, designs and videos that might occur, and we can in no way enforce the ownership rights of the artists, or protect from any public infringement of these ownership rights.
All decisions made by Global Moguls or the voting public in the course of the competition are final and are not subject to review or challenge by the competition participants.
For the term of this agreement, the top 6 artists agree to appear at the final live event at Ratanga Junction in Cape Town on the 27th November. Global Moguls retains the right to schedule and arrange such performances. The travel, accommodation, transport and related costs will be covered by Global Moguls.
The artists agree that the live final will be live-streamed online to a viewing audience, and in no way object to this.
For promotion purposes the artists agrees to attend radio and TV appearances, as Global Moguls sees fit.
The artist approves and permits the use of the artist's name, photograph, likeness, voice, sound effects, caricatures, literary, artistic and musical material for the purposes of advertising and publicity and in the promotion and advertising of the Global Moguls competition. This includes but is not limited to promotion.
The artist shall not detrimentally interfere with the efforts of Global Moguls to promote the artist through one or more means.
The artist approves and permits all publicity, public relations, endorsements, etc.
The artist agrees to participate fully in any promotional activity that Global Moguls deems necessary.
The winning artist agrees to make themselves available for the filming of music videos and recording of their tracks at the Red Bull Studios, as part of the winning artistsŐ prize. All transport, accommodation, travel and related costs are for the account of Global Moguls.
The date and time for the filming and recording will be arranged by Global Moguls and the winning artists agree to make themselves available on the date, and costs incurred due to the artistsŐ failure to appear will be deemed to be the artists.
This Agreement shall be binding upon the successors and assigns of the parties.
In the event of a dispute between Global Moguls and the artist regarding the terms, construction or performance of this agreement, such dispute shall be submitted for arbitration and then to a court of competent jurisdiction within Cape Town. This agreement is governed by South African Law.
In the event that a party is forced to obtain an attorney to enforce the terms of this agreement, the party prevailing in such action of enforcement shall be entitled to the recovery of attorney's fees incurred in such action.
The artist agrees to perform their obligations under this agreement, in all respects, in good faith.
In the performance of his/her obligations of this agreement, the artist shall be deemed an independent contractor.
Global Moguls is not an employment agent or theatrical agent. The parties agree that Global Moguls is not obligated to attempt to secure employment or engagements for the artist. The parties agree that Global Moguls has not promised to procure employment or engagements for the artist.
The artist is fully liable for costs incurred by them in producing any music for the competition, and Global Moguls will not be held liable for these costs, incidental or otherwise.
Global Moguls retains preferential option for contracting the top 6 artists, in terms of a management agreement including, but not limited to, management, touring, merchandise, sponsorship & distribution.
Global Moguls is not liable for any damages incurred by any party during the final event at Ratanga Junction on the 27th of November 2010.
Global Moguls retains the right to remove any content which they deem offensive, and is not liable to any third party for such content.
Any infringement of the terms and conditions will be evidence of breach of contract and as such the artist will expose themselves to litigation and resultant penalties.
